Biography

Ms. Foshee focuses her practice on commercial real estate law with an emphasis on commercial real estate transactions and analyzing potential title issues. Prior to joining St. Amand & Efird PLLC, Ms. Foshee was the assistant vice president and underwriting counsel at Fidelity National Title Insurance Company and Barrister’s Title Services of the Carolinas, LLC where she gained a comprehensive background of complex commercial transactions which involved determining the appropriate and applicable ALTA endorsements and identifying and solving potential title encumbrances in order to best serve the clients. During her tenure as underwriting counsel, Ms. Foshee gained an extensive knowledge and understanding in the evaluation of potential encumbrances and making risk-based decisions in order to provide maximum coverage for the clients, which provides her with a unique perspective on real estate transactions, ALTA endorsements, and potential clouds on title. Her exceptional relationship skills and diverse skillset give her a deep understanding of the industry and a detailed insight to identify the needs of any given transaction. She serves both North Carolina and South Carolina and prides herself on being a trusted ally for the clients she represents. In addition to Ms. Foshee’s work in commercial real estate, she has also volunteered her services to assist the Guardian ad Litem and the Missouri Housing Authority.

  • Representation of national homebuilders in the acquisition of developed lots, undeveloped lots, and vacant land in North and South Carolina.

  • Representation of homeowners’ associations by forming the Owners Associations and drafting Covenants, Conditions, and Restrictions.

  • Representation of builders and developers by reviewing title documents in order to identify and resolve potential title defects.

  • Representation of title company on multiple +$100 MM commercial transactions which required coinsurance in order to facilitate a single physical policy while allocating liability among several title companies.

  • Representation of title company for several commercial loans involving mezzanine financing in which the lien is secured against a beneficial interest of the business entity that owns the land rather than securing the lien against the land.
  • Representation of title company on multi-site deals involving multiple title companies and lenders which required first loss and tie-in endorsements.

  • Representation of title company in acquisition, subdivision, and development of unimproved land, which involved reviewing site plans, zoning reports, and access to confirm compliance with federal, state, and local laws and ordinances.

  • Representation of title company in post-loan transactions including mortgage modifications and construction loan draws.

  • Representation of the title company on matters involving Leasehold Estates, including reviewing the lease in order to issue Leasehold policies and the applicable leasehold endorsement(s).
